Welcome to Wild Foods. "We," "us," and "our" mean Wild Foods. We
operate this store, including the website, content, tools, and
products that make up the shopping experience (the "Services").
Shopify powers our Services.
These Terms of Service, along with any policies referenced here
(the "Terms"), describe your rights and responsibilities when you
use the Services.
Read these Terms carefully. They cover your legal rights, including
warranty disclaimers and limits on our liability.
By visiting or using our Services, you agree to these Terms and our
Privacy Policy. If you don't agree, please don't use the Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm you're at least the age of
majority in your state or province, and that you've consented to
any minor dependents using the Services on devices you own or
manage.
To use the Services, including browsing our store or buying
products, we may ask for information like your email, billing,
payment, and shipping details. You confirm that any information you
give us is accurate, current, and complete, and that you have the
right to provide it.
You're responsible for keeping your account credentials secure and
for all activity on your account. You can't transfer, sell, assign,
or license your account to anyone else.
SECTION 2 - OUR PRODUCTS
We do our best to represent our products accurately. Colors and
appearance may look different depending on your screen and device
settings.
We don't guarantee that a product's appearance or quality will match
exactly what you see in our store or meet your expectations.
Product descriptions can change at any time without notice, at our
discretion. We can discontinue any product, or limit quantities
available to any person, region, or jurisdiction, at any time.
SECTION 3 - ORDERS
Placing an order is an offer to purchase, not a guaranteed sale. We
can accept or decline any order for any reason, at our discretion.
Your order isn't accepted until we confirm it, and we need to
receive and process your payment first.
Review your order carefully before submitting. We may not be able
to accommodate cancellation requests once an order is accepted. If
we don't accept, change, or cancel your order, we'll try to reach
you using the email, billing address, or phone number you provided.
Returns and exchanges follow our Refund Policy. EU/UK customers: see
Section 4 for your separate right to cancel your order within 14
days.
By purchasing, you confirm the order is for your own personal or
household use, not for resale or export.
SECTION 4 - EU/UK RIGHT OF WITHDRAWAL
This section applies only to consumers located in the European
Union or the United Kingdom.
You have the right to cancel your order within 14 days without
giving any reason. The withdrawal period expires 14 days from the
day on which you, or a third party other than the carrier and
indicated by you, take physical possession of the goods.
This right is separate from, and in addition to, our standard
Returns & Exchanges policy.
To cancel your order, you must inform us of your decision before
the withdrawal period expires. You can do this by emailing
info@WildFoods.co with your order number and name. We will
acknowledge receipt of your cancellation without delay.
Effects of cancellation: If you cancel your order under this right,
we will reimburse all payments received from you, including
standard delivery costs (excluding any supplementary costs from
choosing a delivery method other than the least expensive standard
delivery we offer), without undue delay and in any event no later
than 14 days from the day we are informed of your decision to
cancel. We will make the reimbursement using the same payment method
you used for the original purchase, unless you have expressly agreed
otherwise, and you will not incur any fees as a result of the
reimbursement.
We may withhold reimbursement until we have received the goods back,
or you have supplied evidence of having sent the goods back,
whichever is earlier.
You must send back the goods without undue delay, and in any event
no later than 14 days from the day you tell us you're cancelling.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting
from handling other than what is necessary to establish the nature,
characteristics, and functioning of the goods.
Exception for sealed health and hygiene products: This right does
not apply to sealed goods that are not suitable for return due to
health protection or hygiene reasons if they were unsealed after
delivery. This exception applies to our supplement and consumable
products once opened. You retain the right to cancel your order
within the 14-day period; this exception affects only your ability
to return an opened product for a refund under this right.

SECTION 5 - PRICES AND BILLING
Prices, discounts, and promotions can change without notice. You'll
pay the price in effect when you place your order, as shown in your
confirmation email. Unless stated otherwise, posted prices don't
include taxes, shipping, handling, customs, or import charges.
Prices in our online store may differ from prices in physical stores
or other online stores. We may run promotions with their own
separate terms; if those terms conflict with these Terms, the
promotion terms apply.
Keep your account and payment information current and accurate,
including your email and card details, so we can process your
orders and reach you when needed.
You confirm that: your payment information is true and complete,
you're authorized to use that payment method, your card issuer will
honor the charges, and you'll pay the posted price plus shipping,
handling, and any applicable taxes.
SECTION 6 - SHIPPING AND DELIVERY
We're not liable for shipping or delivery delays. Delivery times are
estimates, not guarantees. We're not responsible for delays caused
by carriers, customs, or anything outside our control. Once we hand
off your order to the carrier, ownership and risk of loss transfer
to you.
SECTION 7 - INTELLECTUAL PROPERTY
Everything that makes up our Services, including trademarks, text,
images, graphics, reviews, video, and audio, along with how it's all
arranged, belongs to Wild Foods, our affiliates, or our licensors,
and is protected by U.S. and international law.
These Terms let you use the Services for personal, non-commercial
use only. You can't reproduce, distribute, modify, publicly display
or perform, republish, download, store, or transmit any part of the
Services without our written consent. Nothing here grants you rights
to our patents, trademarks, copyrights, or other intellectual
property, or Shopify's, beyond what's expressly stated. Unauthorized
use may violate federal and state law. We reserve all rights not
expressly granted here.
Our names, logos, product names, designs, and slogans are Wild Foods
trademarks, or belong to our affiliates or licensors. You need our
written permission to use them. Shopify's name, logo, and related
marks belong to Shopify. All other names, logos, and marks on the
Services belong to their respective owners.
SECTION 8 - OPTIONAL TOOLS
We may give you access to third-party tools as part of the Services.
We don't monitor or control these tools.
We provide access to these tools "as is" and "as available," with
no warranties or endorsement of any kind. We're not liable for
anything arising from your use of them.
Using optional third-party tools is entirely at your own risk.
Review and understand the third-party provider's own terms before
using their tools.
We may add new features to the Services over time. Those become
part of the Services and are covered by these Terms.
SECTION 9 - THIRD-PARTY LINKS
Our Services may link to third-party websites or include
third-party content. We don't examine or verify the accuracy of that
content. If you leave our Services to visit a third-party site, you
do so at your own risk.
We're not liable for any harm related to your use of third-party
websites, products, or services. Review a third party's own policies
before transacting with them. Direct any complaints about
third-party products or services to that third party.
SECTION 10 - RELATIONSHIP WITH SHOPIFY
Shopify powers our Services, but every sale you make is directly
with Wild Foods, not Shopify. Shopify isn't responsible for any part
of your purchase, including any injury, damage, or loss from our
products. You release Shopify and its affiliates from any claims
related to your purchases from us.
SECTION 11 - PRIVACY POLICY
Your personal information is covered by our Privacy Policy, and
some of it may also be covered by Shopify's Privacy Policy. Using
our Services means you've read both.
Because Shopify hosts our Services, Shopify collects and processes
data about how you use them, in order to provide and improve the
Services. Information you submit may be shared with Shopify and
other third parties, including ones located outside your country,
so they can help provide our Services. See our Privacy Policy for
details on how we, Shopify, and our partners use your information.
SECTION 12 - FEEDBACK
If you send us ideas, suggestions, reviews, or other feedback
("Feedback"), you give us a permanent, worldwide, royalty-free
license to use, reproduce, modify, publish, and distribute it for
any purpose, including commercially. That might mean using your
Feedback to improve or promote our Services.
You confirm that: you own or have the rights to your Feedback,
you've disclosed any compensation you received for giving it, and
it complies with these Terms. We're not obligated to keep your
Feedback confidential, pay you for it, or respond to it.
We may, but don't have to, monitor, edit, or remove Feedback we
consider unlawful, offensive, or otherwise inappropriate, or that
violates someone's rights or these Terms.
Your Feedback can't violate anyone's copyright, trademark, privacy,
or other rights, and it can't be unlawful, abusive, or contain
malware. Don't use a fake email address or pretend to be someone
else. You're solely responsible for your Feedback and its accuracy.
We take no responsibility for Feedback posted by you or anyone else.
SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS
Our Services may occasionally contain typos, inaccuracies, or
missing information, including in product descriptions, pricing,
promotions, shipping charges, or availability. We can correct
errors, update information, or cancel orders affected by inaccurate
information at any time, without notice, even after you've placed
an order.
SECTION 14 - PROHIBITED USES
Use our Services only for lawful purposes. You may not:
- Use the Services for anything unlawful or malicious
- Violate any law or regulation
- Infringe our intellectual property or anyone else's
- Harass, abuse, or harm our employees or anyone else

- Use bots, scrapers, data-extraction tools, AI agents, or other
automated or manual tools to access the Services
- Bypass, interfere with, or circumvent our security or access
controls
We can suspend, disable, or terminate your account at any time,
without notice, if we determine you've violated these Terms.
SECTION 15 - AGENTS
15.1 This section applies if you use, allow, or cause an "Agent"
(autonomous or semi-autonomous software acting on someone's behalf)
to access or interact with our Services.
15.2 An Agent can't access or use our Services unless it identifies
itself and follows the requirements in 15.4, and only if we haven't
asked that Agent to stay away.
15.3 We may limit, including through technical means, whether and
how any Agent accesses or uses our Services.
15.4 Agents must:
- Identify themselves as an Agent in every request, by including
"Agent/[agent name]" in the request's user agent string
- Not conceal that they're an Agent, including by mimicking human
behavior or bypassing CAPTCHAs
- Answer truthfully if asked whether they're human or automated
- Not bypass any measure we use to control how Agents access our
Services
SECTION 16 - TERMINATION
We can end this agreement or your access to the Services at any
time, at our discretion, without notice. You remain responsible for
any amounts you owe up to the date of termination.
These sections survive termination: Intellectual Property,
Feedback, Termination, Disclaimer of Warranties, Limitation of
Liability, Indemnification, Severability, Waiver, Entire Agreement,
Assignment, Governing Law, Privacy Policy, and any other provision
that should reasonably survive.
SECTION 17 - DISCLAIMER OF WARRANTIES
The information on our Services is provided for general information
only. We don't warrant its accuracy, completeness, or usefulness.
Any reliance on it is at your own risk. We disclaim liability for
reliance placed on this content by you or anyone else.
EXCEPT AS EXPRESSLY STATED BY WILD FOODS, THE SERVICES AND ALL
PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS
AVAILABLE" FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR
CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL
IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE
QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND
NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT
YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR
ERROR-FREE. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER
OF IMPLIED OR OTHER WARRANTIES, SO THE ABOVE DISCLAIMER MAY NOT
APPLY TO YOU.
SECTION 18 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL WILD FOODS,
OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS,
CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND
ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY
DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL
DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS,
LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY
SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING
NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF
ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR
FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES
OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR
OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED
AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT)
POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES,
EVEN IF ADVISED OF THEIR POSSIBILITY.
SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Wild Foods,
Shopify, and our affiliates, partners, officers, directors,
employees, agents, contractors, licensors, and service providers
from any losses, damages, liabilities, or claims (including
reasonable attorneys' fees) owed to a third party because of: (1)
your breach of these Terms or anything they incorporate by
reference, (2) your violation of any law or a third party's rights,
or (3) your access to or use of the Services.
We'll notify you of any indemnifiable claim. A delay in notifying
you won't release you from your obligations unless it materially
prejudices you. We may control the defense and settlement of a claim
at your expense, including choice of counsel, but we won't settle
any claim requiring a non-monetary obligation from you without your
consent, which won't be unreasonably withheld. You'll cooperate in
defending indemnified claims, including by providing relevant
documents.
SECTION 20 - SEVERABILITY
If any part of these Terms is found unlawful, void, or unenforceable,
that part will still be enforced to the fullest extent allowed by
law. The unenforceable part is treated as removed, and the rest of
these Terms remains valid.
SECTION 21 - WAIVER; ENTIRE AGREEMENT
If we don't enforce a right or provision in these Terms, that
doesn't mean we've waived it.
These Terms, along with any policies we post, make up the entire
agreement between you and us regarding the Services. They replace
any prior agreements, communications, or proposals, written or oral,
including earlier versions of these Terms.
Any ambiguity in these Terms won't be interpreted against whoever
drafted them.
SECTION 22 - ASSIGNMENT
You can't transfer, assign, or delegate this agreement or your
rights and obligations under it without our written consent; any
attempt to do so is void. We can transfer, assign, or delegate these
Terms and our rights and obligations without needing your consent or
notifying you.
SECTION 23 - GOVERNING LAW
These Terms, and any separate agreements under which we provide you
Services, are governed by the laws of the State of Delaware. You and
Wild Foods consent to venue and personal jurisdiction in the federal
and state courts located in Delaware.
For consumers located in the European Union or the United Kingdom:
nothing in this clause removes the protection of any mandatory
consumer protection laws of your country of residence, which
continue to apply regardless of this governing law clause.
SECTION 24 - HEADINGS
Headings in this agreement are for convenience only and don't affect
how these Terms are interpreted.
SECTION 25 - CHANGES TO TERMS OF SERVICE
You can review the current version of these Terms on this page at
any time.
We may update, change, or replace any part of these Terms by posting
changes to our website, at our discretion. It's your responsibility
to check the site periodically. We'll notify you of material changes
as required by law, and those changes take effect on the date stated
in the notice. Continuing to use our Services after changes are
posted means you accept them.
